IDENTIFICATION OF THE OWNER AND GENERAL INFORMATION

Christmas Jumpers is the company's trade name. These Terms and Conditions regulate access to and use of the website https://christmasjumper.shop (hereinafter, the Website) owned by COOL CHRISTMAS CLOTHING SL (hereinafter, CCCSL), with Tax Identification Code (CIF) B42975615 and registered office at Plaza Castilla 3, 14 E1, 2. 28046, Madrid (España), as well as the products and services offered by CCCSL on its Website.

CCCSL offers this Website subject to these Terms and Conditions. By visiting the Website or using the services or applications thereof, the user (hereinafter, User(s)) accepts these Terms and Conditions.

Users are not required to register to access the Website. However, in order to procure any of the services offered by CCCSL, the User may be asked to register and accept these terms and conditions before completing the payment.

Through the Website, CCCSL offers Users Christmas jumpers.

These CCCSL Terms and Conditions described hereafter define the rights and obligations of CCCSL and the Users in relation to the Website. These are the only Terms and Conditions applicable to the use of the Website (without prejudice to any specific conditions for certain services) and to the placing of orders via the Website and replace any other conditions, unless previously agreed in writing between CCCSL and the User.

 

USER DATA

Users will not strictly be required to register using the registration form available on the Website in order to purchase the products offered on the Website. Users may purchase the products without having to register and without the obligation to do so.

At christmasjumper.shop, all of the website pages and data are protected for the User via the SSL (secure sockets layer) security certificate. As such, any data entered are secure.

The User will be liable for maintaining the confidentiality of the data and information provided and for restricting access to their computer and passwords to avoid potential unauthorised use.

If the User has reason to believe that their data have been disclosed to a third party or if they have been used without authorisation, or are likely to be, the User shall immediately inform CCCSL of the situation.

The User shall check that their data are accurate and complete and shall inform CCCSL when there are any variations or changes in the information provided during the purchase process.

 

ORDERS AND SALES CONDITIONS

The products and services offered via CCCSL's website are intended for the purchase of Christmas jumpers by the Users.

In order to place an order with CCCSL, Users must be over the age of 18.

In order to place orders via the Website, the User shall provide a set of data prior to submitting the order using the purchase form. These data will be required to process their purchase order.

 

PRICE, PAYMENT METHOD AND DISCOUNT CODES

After filling out the form, the User may proceed to the payment of the order using the payment methods specified on the Website.

We currently accept credit cards (Visa, Maestro, American Express, Mastercard...), PayPal, Shop Pay, Google Pay and Amazon Pay. Our transactions are always secure and encrypted.

CCCSL is responsible for transactions through Shopify Payments payment gateways.

After making the payment, the User will receive an order confirmation email including a summary of the items purchased, the shipping method requested and the destination address.

If an incident arises during payment that prevents the order from being placed, the User will receive an automated payment error message and their order will not be processed until the payment process is successfully completed.

The prices of the services are expressed in euros (€) and also pounds (£), including taxes and processing and shipping fees, the amount of which will be stated at the final confirmation stage of each order.

All prices shown are final, expressly including value-added tax (VAT), although users may access a breakdown of the product price at any time.

CCCSL reserves the right to change prices without prior notice. However, upon receipt of the order confirmation, the prices payable for the order will not be affected.

CCCSL informs the User that in spite of the updates that are made to the prices of the products offered on the Website, these may contain errors. We will promptly correct any errors that appear, but they will not be binding.

Prices shown on the Website based on a possible obvious typographical error, such as, for example, products published with a price at zero euros/pounds or at an insignificant, negligible or derisory price (or absolutely disproportionate in relation to their market value) shall not form part of the order when such error was known to the User at the time of purchase and the User had acted contrary to good faith.

CCCSL may occasionally offer discount codes to its Users. Such discounts may only be applied according to the instructions stipulated by CCCSL with regard to each code. In any case, Users may only use one code per order.

The use of discount codes will not be compatible with certain promotional events and collections.

Discount codes are not redeemable for cash.

 

Shipping

The preparation of the order and the subsequent dispatch of the products purchased will only be carried out once full payment has been made and received. As long as the payment has not been received, the purchase will not be considered as completed.

 

Delivery methods and Shipping costs

From the Website, CCCSL makes the Delivery 3-5 days service available to the User. The User receives their order within 3-5 working days from the day the order is prepared.

This service costs £5.99 for orders to the United Kingdom and 5.99€ for orders to countries in the Eurozone. Only orders of £80 / 80€ or more will get this free delivery service.

CCCSL establishes that order preparation hours are from Monday to Friday from 8:00h to 12:00h (GMT+2), except national holidays. All orders placed through the Website outside the order preparation hours will be prepared and dispatched on the next working day.

CCCSL reserves the right not to ship orders to any country in Europe that does not belong to the Eurozone, as well as to any country in Africa, Asia and America. 


Delivery

Orders will be delivered to the delivery address freely designated by the User, within the aforementioned deadlines. These delivery times may be longer in periods of sales, Black Friday, Christmas or specific promotions.

CCCSL does not assume any responsibility when the delivery of the order placed through the Website is not carried out as a consequence of the data provided being false, inaccurate or incomplete or when the delivery cannot be carried out for reasons beyond the control of CCCSL, such as the absence of the addressee, retention of the shipment in customs, traffic accidents or climatic incidences. Under no circumstances will this delay entail the obligation to pay any compensation whatsoever.

For the purposes of these Conditions, delivery shall be understood to be formalised at the moment when the User, or a third party duly designated by the User, acquires material possession of the Products, which shall be accredited by means of personal identification at the moment of receipt of the order at the delivery address indicated by the User.



Policy on returns, exchanges, defective products, cancellations and order modifications. Right of withdrawal

Modifications and cancellations

Modifications or cancellations of an order placed by the User through the Website are possible as long as the order has not yet been prepared. If the order has already been prepared, CCCSL reserves the right to modify or cancel the order. In no case will it be possible to modify or cancel an order that has already been sent.

In any case, it will be the User's responsibility to contact CCCSL by any of the means available on the Website. CCCSL will make every effort to make the requested modification or cancellation before the order is prepared and shipped. In any case, CCCSL will assume any kind of responsibility if it is not possible to carry out the modification or cancellation requested by the User and the order is prepared and shipped.


Size exchanges

The User has the right to request an exchange of the size of a product ordered through the Website within fourteen (14) calendar days from the day on which the order was received by the consumer or a third party indicated by the consumer, other than the carrier.

Size exchanges cost £5.99 for orders from the UK and 5.99€ for orders from Eurozone countries.

The User may request a size exchange through the channels available on the Website, where he/she will be informed on how to proceed with the exchange. CCCSL reserves the right to modify the procedure for size exchanges without prior notice.

CCCSL will not accept an exchange of size of garments that, once received in the warehouse, show any of these signs:

  • Signs of having been worn, for example, stains or tears.
  • It gives off bad smells.
  • The label has been removed.
  • Loss of one or more parts or components on 3D models or LED Light Up models.

During the size exchange process, CCCSL will consider this size exchange process to be completed if, 21 calendar days after the last communication with the User, CCCSL has not received a reply from the User through any of the communication channels available on the Website.



Model exchanges

CCCSL reserves the right to make model changes to the products ordered through the Website. In the event that the User wishes to change the model of one of the products he/she has purchased, he/she must request a return of said product and place a new order.



Defective products

It is the User's responsibility to check the external condition of the package(s) and to make all relevant reservations upon receipt of the order.

In the event of serious damage to the package (open, damaged, etc...), it is advisable to refuse delivery. If for any reason it has not been possible to refuse the package or the defect is not visible from the outside of the package, the User has 48 HOURS to contact CCCSL and make a complaint indicating the defects with photographs and videos of the material received such as the box, the transport label and the defective product in question.

Once more than 48 hours have elapsed since receipt of the order by the User, any requested return will be processed as a return for withdrawal.

The User shall use the communication and contact channels described on the Website to provide the necessary information. This information will be reviewed and, in the event that the return is confirmed due to tare, defect or receipt of an erroneous product, CCCSL will assume the replacement of a product of the same characteristics and conditions.

CCCSL will send a new order and it will be the User's obligation to download a new label, pack the defective product and deposit it at a collection point of his choice within a maximum period of 15 days from the first communication.

Whenever a return is confirmed due to a fault, defect or receipt of an erroneous product, the same product purchased by the User will be replaced. Only in the event that the product is out of stock or out of stock and its replacement is not possible, the User may request an exchange for another product or the reimbursement of the amount of the defective product.

Products that show defects or deterioration caused by external factors (accidents, wear and tear, misuse or improper handling of the product), as well as products whose original form has been manipulated, altered or repaired by the customer or by third parties not authorised by us, will not be processed for return due to manufacturing defect or tare.

During the return process due to a fault, defect or receipt of an erroneous product, CCCSL will consider this return process finished if, 21 calendar days after the last communication with the User, CCCSL has not obtained a response from the User through any of the communication channels available on the Website.


Right of withdrawal

In accordance with EU regulations, the User has the Right of Withdrawal, by virtue of which he may return the product received if he finds that it does not meet his expectations within a period of fourteen (14) calendar days from the same day on which the consumer or a third party indicated by him, other than the carrier, received the order.

For hygienic reasons, it is not possible to return or exchange products from the socks, underwear, earrings and headbands collections.

Returns accepted for processing will be charged a handling and shipping fee of £5.99 for orders placed from the UK and €5.99 for orders from Eurozone countries. This cost will be deducted from the amount to be refunded.

CCCSL will not accept a retunr of garments that, once received in the warehouse, show any of these signs:

  • Signs of having been worn, for example, stains or tears.
  • It gives off bad smells.
  • The label has been removed.
  • Loss of one or more parts or components on 3D models or LED Light Up models.

In this case, the return request will be cancelled and the product will be sent again to the same delivery address previously indicated by the User, who will assume the costs of this new shipment.

Before submitting the return request, the customer must choose between these two return methods:

  • Store credit refund: a discount voucher will be generated for the same amount as the purchase plus an extra 10% up to a maximum of £5. This voucher expires 3 years after the date of purchase.

  • Refund: the purchase amount plus shipping costs will be refunded using the same payment method used for the purchase.

This choice is entirely up to the customer and, under no circumstances, can CCCSL modify it without the customer's consent. Please note that, for billing reasons, once forty (40) calendar days have passed since the purchase, it is not possible to change the refund method.

Once a return or size exchange has been requested, the customer has a period of 15 calendar days to download the return label and drop the parcel off at a pick-up point of their choice. If the shipment is not made within this period, the return may be cancelled and, as a gesture of goodwill, store credit for the corresponding amount may be offered.

If, within a period of forty (40) calendar days from the date the return request is submitted via the returns portal, we have not received the parcel at our facilities, and provided that the non-receipt is not attributable to duly evidenced logistical issues on the carrier’s side, the return will be definitively cancelled and no refund will be issued.

Exceptionally, and as a strictly commercial gesture, COOL CHRISTMAS CLOTHING SL may offer the customer store credit for the value of the product. Acceptance of this store credit will be voluntary and it shall not, under any circumstances, be considered a refund.

For refunds that are accepted for processing, the price of the product and the initial shipping costs (only in cases where the customer has paid shipping costs) will be refunded no later than fourteen (14) days after the product is received at the CCCSL facilities.

The same means of payment used for the initial transaction will be used for the reimbursement. In any case, the reimbursement of the amount will not entail the obligation to pay any fee or commission. 

The reimbursement of the amount may be withheld until the items returned by the User have been received or until proof of having returned the items has been provided, whichever occurs first.

During the return process, CCCSL will consider this return process to be completed if, 21 calendar days after the last communication with the User, CCCSL has not received a reply from the User through any of the communication channels available on the Website.



 

Information on the products and services of Christmas Jumpers

The data included on the Website in each product and service description, their photographs, graphic or iconographic depictions and videos as well as trade names, brands or distinguishing signs of any kind, are for informational purposes only. As such, CCCSL accepts no liability for any errors in such information, although it undertakes to take any measures within its power to correct such errors or omissions as soon as possible after being informed thereof.


 

USE OF THE WEBSITE

Use of the Website for fraudulent purposes or for uses related to criminal offences or illegal activities of any kind is not permitted. Sending, using or reusing illegal, offensive, abusive, indecent, defamatory, obscene or threatening material of any kind, or material that violates intellectual property rights, trademarks, confidentiality, privacy or any other right, or material that is otherwise injurious or objectionable to third parties, or whose content contains a computer virus, political propaganda, marketing content, chain letters, mass mail or any other type of spam and, in general, any type of unnecessary nuisance or inconvenience, is also prohibited.

The User undertakes to legally, diligently, honestly and properly use any information or content to which they have access, either via the Website or third-party websites to which they have access through links from the Website. The User shall follow the principles of good faith and shall follow the applicable legislation and these Terms and Conditions at all times.

In addition, the User shall not maliciously or intentionally cause damage that may undermine or alter the Website and shall not introduce or spread computer viruses that may cause unauthorised changes to the Website content or integrated systems.

CCCSL reserves the right to deny Users access to the Website or even to cancel their orders if they misuse the content and/or breach any of the conditions that appear in this document.

 

 

INTELLECTUAL OR INDUSTRIAL PROPERTY

The intellectual property rights on the Website https://christmasjumper.shop, its source code, design, browsing structures and the different elements contained in it belong to CCCSL, which has the exclusive right to use them in any manner and, in particular, copyright, distribution rights, public disclosure and transformation rights, in accordance with applicable Spanish and European legislation. CCCSL does not grant any express or implicit licences or permission concerning the intellectual and/or industrial property rights or any other right or property that is directly or indirectly related to the content of the Website. Full or partial reproduction of the content of the Website, even via a hyperlink, without CCCSL's express written consent, is completely prohibited. Unauthorised use of this content will give rise to the legal actions laid down by law.

 

 

HYPERLINKS

Hyperlinks on the Website may lead to third-party websites. CCCSL accepts no liability for the content, information or services that may appear on such sites, which are understood to be exclusively offered for informational purposes by CCCSL. Under no circumstances do such information or services imply any relationship, acceptance or endorsement between CCCSL and the persons or entities that own such content or the sites on which they are found.

 

 

PARTIAL NULLITY

In the event that any clause in these Terms and Conditions is declared null and void, the other clauses will remain in force and will be interpreted taking into account the spirit of these Terms and Conditions.

 

 

AMENDMENTS

The information that appears on this Website is current on the date of its last update. CCCSL reserves the right to unilaterally amend these Terms and Conditions, as well as its privacy policy and any other information. The amendments of the Terms and Conditions will enter into force as soon as they are published on this Website.

 


NOTIFICATIONS

All communications between CCCSL and the User pertaining to the placing of orders via the Website will be in writing and in accordance with the communication procedures established in these Terms and Conditions for each specific case.



LANGUAGE

CCCSL may translate these Terms and Conditions, its Privacy Policy or any other operational, policy or procedural rule that may be published on the Website. The Spanish version will prevail in the event of a dispute.


 

APPLICABLE LEGISLATION AND JURISDICTION

These Terms and Conditions are subject to Spanish legislation. In accordance with Spanish Royal Legislative Decree 1/2007, of 16 November, which approves the consolidated text of the Spanish Consumer Protection Act (Ley General para la Defensa de los Consumidores y Usuarios) and other complementary laws, the parties hereby submit to the Courts and Tribunals of the User's place of residence. In addition, by virtue of the provisions of Regulation (EU) No. 524/2013 of the European Parliament and of the Council, of 21 May 2013, on the resolution of online consumer disputes, CCCSL hereby informs the User that, in the event of a dispute, Users residing in the European Union may use the Online Dispute Resolution Platform developed by the European Commission, in order to try to resolve any dispute out of court that has arisen from the provision of services by CCCSL.
